In Wii Sports at least, the file is loaded on boot, but the game doesn't crash if the file isn't present or is filled with random data.
The file isn't used. boot.dol contains a list of parameters, including ones that don't appear in the config file:

Despite the fact that the trademark was registered in the region before the release, the USA and European version has the "TM" symbol after "Wii", rather than after "Sports" like in the Japanese version and the later South Korean version.
